Anyway around this, or is it a bug?

I was going to suggest last night that you removed the second infobox, but after doing some playing around that clearly isn't the issue and this is most definitely a bug.

This isn't a bug, the system is acting normally. You're using headers so you *will* get a TOC in that block. I've edited the Infobox template to include a bit of code which will disallow TOC's.
